1. General

These terms and conditions (“Terms”) govern the use of the Makia online store and all orders placed through it. By using the online store you accept these Terms and agree to follow them.

We reserve the right to change or update the content of the online store, including changes to prices, product selection or these Terms. In case we make substantial changes to these Terms or Privacy Policy, we aim to notify our Customers in advance on our website.

The online store is primarily targeted for Finnish consumers. However companies and consumers abroad are, subject to certain restrictions, also able to use it. Please note that companies are not entitled to invoke rights based on Finnish consumer protection legislation.

3. Orders

To place an order you must meet the criteria set for ordering and give true and accurate information of yourself. You must be at least 18 years old to place an order in Makia online store.

You may submit an order either as a registered customer or without creating an account.

All orders must be placed online. We do not accept orders via phone or email.

We reserve the right to cancel placed orders. A binding order contract will only be formed when we send you an order confirmation confirming the availability and delivery time of your order.

For orders outside the EU, the customer is responsible for any taxes and duties required by their own country. For orders outside the EU we do not charge the Finnish value added tax.

Please note that all discount and promotion codes can be used only once and cannot be combined with other discounts or offers. Discount or promotion codes will not be deducted afterwards.

Gift cards are valid for 12 months after purchase. Gift cards cannot be exchanged for money.

Your personal data is saved to our customer register. For more information about the processing of personal data please see our Privacy Policy.

4. Payment terms

All prices shown in our online store are in euros.

Customers from non-EU countries are exempt from paying the Finnish VAT, but are responsible for possible customs, local VAT and similar expenses in their own country.

Payment methods

We use Paytrail and Paypal as our external payment services providers.

Paytrail

With Paytrail the accepted payment methods are Visa, Visa Electron and MasterCard payments, as well as payments via the following netbanks:

Osuuspankki, Nordea, Sampo Pankki, Aktia, Säästöpankki, Paikallisosuuspankki, Nooa, Handelsbanken, Tapiola, Ålandsbanken, S-Pankki. and certain credit institutions.

When paying with Paytrail, Paytrail Oyj may appear as the payment recipient.

PayPal

In order to use PayPal payment method, you must have a personal PayPal account from which the transfer is done. More information about Paypal is available on the Paypal website.

5. Shipping and delivery time

Delivery time of our products depend on the product’s availability and the destination of the delivery. We reserve the right to deliver the orders in multiple deliveries.

Shipping fees depend on the chosen delivery method. For international deliveries your delivery options and costs are determined on your zip code and country.

You will be shown the available delivery methods and shipping fees before you check out.

Please note that we use external service providers for carrying out shippings.

Shipping in Finland

All orders in Finland are shipped either by PostNord’s MyPack or PostNord’s Mypack Home-service. More information about the Mypack service and tracking is available here.

International shipping

International orders are shipped either by PostNord (DPD), United Parcel Service (UPS) or DHL. The shipping methods available are shown once the delivery address is submitted.

Please note that all delivery times are estimates based on average delivery times from our shipping partners, and we cannot guarantee delivery within the estimated time. We are not responsible for any delivery delay. Weekends and holidays are not included in the delivery days.

6. Return policy

Consumers have the right to cancel their order placed through the online store and return the product within 30 days of receiving of the order. Please note that the return policy does not apply to custom made or tailored products, or for sealed products if the seal has been broken.

The returned product must be unused and capable of being resold. The product must be packaged either in its original packaging or in a similar manner.

You may use our return form when returning your order.

7. Liability

We are not responsible for delays or damages due to any obstacle beyond our influence. These type of force majeure situations include unusual natural phenomena, disturbances in transportations, and strikes or trade or export prohibitions.

We are also not responsible for any disturbances, interruptions or downtime of the online store.

Consumers

These terms do not limit Makia’s liability under applicable consumer protection laws, such as liability for defects.

The customer must give notice of a defect of an item within a reasonable time from detecting the defect, however, preferably no later than within two months.

Companies

Makia is not responsible for any consequential or indirect damage. Our aggregate maximum liability for damages shall be limited to 100% of the purchase price.

8. Intellectual property rights to the content of the online store

The content of Makia online store, including pictures, videos, texts, product information, trademarks and charts are property of Makia and/or it’s partners or licensors. Unauthorized use or copying of the contents or material of the Makia online store is prohibited.

Makia is a registered trademark.

9. Personal data and data protection

We are responsible for processing and storing customer data carefully. For more information regarding the processing of personal data and data protection please read our Privacy Policy.

10. Applicable law and disputes

These Terms are governed by the laws of Finland, excluding its provisions regarding choice of law.

Any disputes that cannot be solved by negotiations, shall be subject to the exclusive jurisdiction of the Finnish courts.

Consumers can also seek advice from the Finnish Consumer Advisory Services (Kuluttajaneuvonta) or contact the Finnish Consumer Dispute Board (Kuluttajariitalautakunta) for a recommendation.
